SUPER.SET.GO! (OPERATED BY 65&BAY PTE. LTD. 202443104D) MEMBERSHIP TERMS
YOUR MEMBERSHIP AGREEMENT HAS A MINIMUM INITIAL COMMITMENT PERIOD OF 6 MONTHS OR 12 MONTHS FROM THE START OF THE FIRST MONTHLY BILLING PERIOD FOLLOWING YOUR MEMBERSHIP START DATE SET OUT IN YOUR MEMBERSHIP APPLICATION FORM AND IT AUTOMATICALLY RENEWS FOR FURTHER ONE MONTH COMMITMENT PERIOD UNLESS TERMINATED UNDER PARAGRAPH 8.3.
1. THE AGREEMENT BETWEEN YOU AND US
1.1 Your membership
These Terms, together with the club rules and the following completed documents:
a. your Membership Application Form;
b. your payment authority;
make up all of the terms of a Membership Agreement (“Agreement”) between the member named above (“you”), and 65&Bay Pte. Ltd. (Registration Number 202443104D) (“us”). It is important that you have read and understood all of the terms and conditions of the Agreement before accepting these Terms. If you have any questions, please ask us.
1.2 Corporate members
If you are a corporate member, you will also have to produce proof of your corporate identity to us. Extra or different terms (“Corporate Terms”) might apply to you because of the corporate membership agreement between us and your employer, which has taken out corporate membership with us. In particular, the conditions to end or freeze the Agreement may be different for corporate members.
The Corporate Terms form part of the Agreement between us, as well as the documents listed in paragraph 1.1 above. If there are any differences between any part of these Terms and the Corporate Terms, the relevant terms of the Corporate Terms will take priority. The company which is allowing you to benefit from corporate membership is responsible for making you aware of any Corporate Terms that apply.
2. YOUR TYPE OF MEMBERSHIP, YOUR HOME CLUB AND OTHER CLUBS
You are becoming a member of SUPER.SET.GO! under the type of membership (“Membership Type”) and at the club (“Home Club”) stated in your Membership Application Form. Your membership entitles you to use the facilities available at your Home Club. “Club” means any SUPER.SET.GO! club in operation by us. Subject to our ALL CLUB memberships, you may also use the facilities of any other Club in Singapore. This benefit is not available to some membership types.
3. YOUR MEMBERSHIP START DATE
Your membership will start on the Membership Start Date (“Membership Start Date”) set out on your Membership Application, provided that:
a. you have agreed to these Terms, and your payment authority;
b. we have received your Total Upfront Payment as set out in your Membership Application Form.
4. YOUR MEMBERSHIP DURATION
4.1 Commitment Periods
Commitment periods are fixed periods where your full billing payments have to be made for recurring memberships, subsequently after the lock in period it will be a non-commitment monthly billing.
Your Commitment Periods include both an Initial Commitment Period and Ongoing Commitment Periods. You are committed to a minimum initial period of membership (“Initial Commitment Period”) such that:
a. your Membership Start Date is the first day of your membership purchase unless requested otherwise
On completion of your Initial Commitment Period on the end date set out in your Membership Application Form which is 6 months or 12 months, your membership will automatically renew for further one month Commitment Period (“Ongoing Commitment Period”) unless your membership is terminated in accordance with paragraph 8 or you provide us with notice that you wish for your membership to end on the expiry of the Initial Commitment Period which we must receive in writing at least 5 days prior to the end of your Initial Commitment Period. Each Ongoing Commitment Period will begin on the first day after your previous Ongoing Commitment Period ends.
5. MEMBERSHIP DUES AND FEES
5.1 Starter Pack
The Starter Pack stated in your Membership Application Form is non-refundable and is payable by you when you sign these Terms. If your membership is terminated for any reason and you subsequently wish to re-join any Club you will need to pay the Starter Pack and Membership Fees applicable to that Club at that time.
5.2 Membership Dues
As a SUPER.SET.GO! member you are personally responsible for payment of the Membership Dues and any other ongoing payments set out in your Membership Application Form as they fall due. As a 6 or 12 Month Member, your Membership Dues are payable for the whole of your Initial Commitment Period at the total cost set out in your Membership. Your Membership Dues are due for the whole of each Commitment Period even if your membership is terminated during the Commitment Period (unless you have terminated your membership under paragraph 8.2). You must pay the Membership Dues applicable to your Home Club and your Membership Type at the relevant time. You will not be allowed to access the Club if your Membership Dues remain outstanding. We will collect any outstanding amounts and any charges we incur from late payment through your payment authority.
5.3 Changes to Membership Dues
Upon the expiry of the Initial Commitment Period your Membership Dues will be updated to the Membership Dues then applicable at your Home Club at that time. This may result in an increase to your Membership Dues after the Initial Commitment Period. We will give you at least 14 days’ notice of any change and the date from which the change will apply by emailing you, notifying you via your member app or writing to you at the contact address you have provided to us. After the Initial Commitment Period, if you do not wish to accept an increase in your Membership Dues you may terminate your membership in accordance with paragraph 8.3. If you do not terminate your membership you will be required to pay any revised Membership Dues from the date from which the change becomes effective and your credit card or other payments will be amended accordingly.
5.4 Other membership fees and charges
Any fees or charges that may be payable for additional services and facilities, such as Suspension Fees, Guest Fees, etc. may be amended by us from time to time
6. TRANSFER OF MEMBERSHIP
You may not transfer your membership to another person. We may however review on a case basis for medical, personal or any other extraordinary circumstances. Given substantial documents and justification we may allow for the transfer of membership. The member is still liable to make payment on monthly dues until he/she has found someone to transfer their membership successfully to. This is however subject to management’s discretion.
7. FACILITIES
We may need to adjust the availability of certain facilities at the Club on a temporary basis including for the purposes of cleaning, improvement work, repairs, upgrades, maintenance, special functions and holidays. If your Home Club is not available for more than seven days in a row, you can ask for a credit against your Membership Dues for the period that your Home Club is not available.
8. MEMBERSHIP TERMINATION
8.1 Termination by us:
We may terminate your membership immediately by emailing or writing to you at the contact addresses we have on our records:
a. If you commit a serious or repeated breach of these Terms or the Club Rules.
b. If you otherwise breach these Terms or the Club Rules and the breach, if capable of remedy, is not remedied within 14 days of us giving you notice to do so and informing you that your membership will be terminated if you fail to do so.
c. If any part of your Membership Dues remains unpaid 60 days after falling due.
d. If you provide us with details which you know to be false when applying for membership and these false details may have affected our reasonable decision to grant you membership. If we terminate your membership for any of these reasons we may (without limiting any other right or remedy) recover any other reasonable costs and expenses we incur as a result of your breach and to collect the full amount of Membership Dues for the remainder of the then current billing period, any arrears and any applicable Early Termination Fee.
e. If we close your Home Club, your membership will end on the date that your Home Club is closed.
9. CLUB RULES
The Club Rules govern your use of the Club. In becoming a member, you agree to comply with the Club Rules which are binding rules that apply to all members, guests and visitors. You are also responsible for the conduct of your guests and visitors while they are using the Club. Up-to-date Club Rules will be displayed in each Club. Please always adhere to the safety advice and instructions given by staff of SUPER.SET.GO! Examples of Club Rules are as follows but not limited to:
a. Causing physical or mental harm to others.
b. Disobeying club protocols like listening to own music while performing in the circuit
c. Damaging Club property and equipment
d. Unruly or lewd behaviour
10. CHANGES TO THESE TERMS OR THE CLUB RULES
We reserve the right to make reasonable amendments to these Terms or the Club Rules at any time. We will give you at least 14 days’ notice by emailing you, amended notifying you Terms via your membership app, or writing to you at the contact address you have provided to tell you that changes are being made and that you may see the or Club Rules at the Club.
11. CONTACTING US AND CORESSPONCDENCE
All communication and requests regarding Memberships should be made to contact@supersetgo.com. Members will be engaged in communication through various means such as messaging apps, phone calls and Email. These communications will be made via official channels and numbers. Certain communication with Personal Training Clients will be handled in confidence via personal communication methods with their assigned Trainers.
12. ACKNOWLEDGEMENT AND ASSUMPTION OF RISK
Exercising and using Club facilities may involve the risk of injury. Your exercise and use of the Club facilities are undertaken at your own risk. Please monitor your physical condition at all times and exercise to a level that is appropriate given your knowledge of your health and any physical injuries that you might have. Please remind staff of any injuries/illness you might be afflicted with in order for them to better manage your participation. The Member agrees that he/she is a voluntary participant in the physical activities and use of facilities and is therefore assuming all risk of injuries to him/her on the Member’s physical condition which may or may not result in the identification of any health risk factors prior to his/her starting or continuing of any exercise activities.
12.1 Guests
All Guests of Members and walk-in visitors to the Club will be subject to the following assumption of risks. We may restrict overall or individual guest privilege or use of the Club at our discretion.
13. PERSONAL DATA PROTECTION ACT
We take the privacy of our members seriously. We will collect personal information from you that may relate to your physical health or condition, including through your Membership Application Form, any changes in contact information as well as the Signup Form. Should you default on payments due to us we may notify a credit reference agency or other third party to obtain payment from you. If you have any request concerning your personal information, please contact us.
14. LIABILITY
14.1 Use of facilities
If you are injured in the course of, or as a result of, using the Club, SUPER.SET.GO! and its Operator (65&Bay Pte. Ltd.) will not be liable except to the extent caused by our negligence. You acknowledge and agree that any such member of 65&Bay Pte. Ltd. shall be entitled to rely on and/ or enforce the foregoing exclusion as if it is a party to this Agreement.
14.2 Liability for supply of other services
65&Bay Pte. Ltd. will not be liable for any data breach on the part of our vendors. By signing below or accepting these conditions on the SUPER.SET.GO! app, you agree to be bound by this Agreement. If you are joining us as a linked member, please note that each linked member who signs below or accepts the conditions electronically will be individually bound by the Membership Agreement.
Do not sign below until you have read these Terms and the other documents listed in paragraph 1. If there is anything you do not understand, please ask us for an explanation before you sign up.
PERSONAL TRAINING TERMS AND CONDITIONS
CLIENT AGREES THAT THEY INTEND TO USE Super.Set.Go! PERSONAL TRAINING (PT) SERVICES AS PROVIDED BY 65&BAY PTE. LTD AND THEREFORE IS WILLING TO OBEY THE FOLLOWING TERMS AND CONDITIONS.
1. PAYMENT OF PACKAGE
PT services can only be used once all payment obligations have been made by client according to package chosen by the client.
1.1 REFUNDS/TRANSFER/CANCELLATIONS
The client acknowledges and agrees that all payments made to Super.Set.Go! cannot be refunded and/or not transferable and/or cannot be used as payment of membership. Transfer of PT sessions can be brought to management considerations under very specific conditions such as medical or extraordinary circumstances.
3.1 SCHEDULING
The client shall be obligated to make an advance schedule pertaining to their PT session no later than 72 hours prior to when their session will be held. Clients are to ensure that they use the PT booking system via the app to book and confirm their sessions.
In case of rescheduling or cancellation, any AM session changes have to be communicated to the trainer at least 12 hours prior to scheduled session and any PM session changes have to be communicated at least 5 hours prior to scheduled session. Failure to do so will result in forfeiture of session. In the event of an unexpected situation or severe medical condition, this forfeiture will be at the discretion of management.
3.2 EXTENSION OF CONTRACT
In the event that the client or trainer have a previously communicated and agreed upon legitimate reasons for absence, this will result in the extension of contract expiry. Such reasons may include but are not limited to medical leave, work travel or national service, etc. However, priority will still be given to ability to schedule minimum requirement of PT sessions in a month over any duration of extension due to absence. Any extension given on a PT package will still be based on a prorated number of days as prescribed above in point 2.3.
5. LIABILITY AND ASSUMPTION OF RISK
In the implementation of PT services selected voluntarily by the client and conducted by professional trainers there is a risk that may arise either directly or indirectly to influence the situation and/or health conditions of the client. The client hereby represents and warrants that 65&Bay Pte. Ltd. is not responsible for the situation and/or health condition of the client.
The use of the facilities at Super.Set.Go! (owned and operated by 65&Bay Pte. Ltd.) and Personal Training services involves inherent risk of injury whether you or someone else cause it. As such, you understand and voluntarily accept this risk and agree that 65&Bay Pte. Ltd. will not be liable for any injury, without limitations, personal, bodily or mental injury, economic loss or any damage to you resulting from the negligence or other acts of 65&Bay Pte. Ltd. or anyone else using the facilities. If there is any claim by anyone based on injury, loss or damage described here, which involves you, you agree to
1) Defend 65&Bay Pte. Ltd. against such claims and pay them for all expenses relating to the claim and
2) indemnify 65&Bay Pte. Ltd. or anyone else from such claims.
